Leaving specific items can be simple, yet perhaps the most important part of your estate plan. This is your chance to leave your legacy or family heirlooms to the right people. In Florida, the easiest way is to prepare a Last Will or Living Trust with an incorporated Memorandum of Tangible Items (“Memorandum”). This can also be an area of contention for beneficiaries, often difficult to resolve. The specific items may be items of sentimental value having zero monetary value.  When conflicts arise lack of monetary value makes it difficult to justify the costly expense of litigation. Alternatively, there may be only one unique specific item that cannot be split or duplicated, how do you distribute the one item fairly? These are all issues where an experienced Estate Planning attorney can assist you to keep your family out of court.
